Considering divorce, need legal counsel --- there are two options: litigation and mediation.
Generally, mediation works better when the divorce background involves:
- Parties who realize they have to part ways and recognize that a neutral third party would help them control the divorce process and keep costs down.
- Situations where there is room for compromise on the basic issues: child custody, child support and alimony --- a good chance to resolve issues of home, pension, children’s educations and division of assets.
- Instances where both parties are doing what’s in the best interests of their children.
Divorce mediation offers creative solutions that benefit both parties. It involves confidential settlement discussions by parties in front of an impartial professional that allow divorcing spouses to resolve their differences with far less acrimony and expense. It provides the opportunity to maintain a working relationship between spouses that might otherwise be destroyed by contentious litigation. Post-divorce mediation provides an economical, confidential and fast resolution of a divorce that might otherwise be mired in the court system for years.
