Generally, litigation is the better option when there is:

On the other hand, mediation generally works better when the facts involve:

- Situations where there is room for compromise on routine and emotional issues: child custody, child support and alimony --- a good chance to resolve issues of home, pension, children’s educations and division of assets.
- Instances where both parties are doing what’s in the best interests of their children.
